The Regulation is a European Union Regulation that sets out the data entitlements of data subjects and the obligations of those who process the personal data of data subjects. The Act defines ‘Personal Data’ as “any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.”

Our data subjects have been identified as, (i) Our Candidates- Persons of legal age in search of employment opportunities and offers who are duly registered on the Site as ‘Candidates’; and (ii) Our Recruiters- Corporations, Organisations, Partnerships or other entities with vacancies, seeking suitable candidates to take certain roles and fill their vacancies.

INFORMATION COLLECTION AND USE

  1. Candidate:

We obtain personal information and identifiers which identify you personally as an individual. These identifiers include your:

  • Name;
  • Address
  • Email Address(es);
  • Telephone Number(s);
  • Education ;
  • Work History and Experience;
  • Social Media Handles;
  • Curriculum vitae;
  • Reference Information; and
  • Emergency Contact Details (Name, address and phone number).

We need these identifiers and personal information/data for and put them to use through the following ways:

  1. Process your registration with the Site;
  2. Facilitate ease of using the Site, by not having to enter information repeatedly;
  • Suitably project you to recruiters for your desired positions which may be available;
  1. Alert you of information regarding employment opportunities or career-related tips/information;
  2. Facilitate a seamless application for advertised positions that are of interest to you;
  3. Reach out to you in the event of a successful application; and
  • Dispatch automated email messages and texts which include, but not limited to marketing materials for our services and providing you with requested information or services.

We may share your personal information to recruiters, government authorities, regulatory authorities or court when we have compelling reasonable reasons to do so, or; (a) in compliance with extant laws and regulations; (b) to protect and defend the rights or property of Balance of Creation Limited and our family of Sites; (c) to act in urgent circumstances to protect the personal safety of other Users of the Site, staff of Balance of Creation or members of the public; (d) in conformity with an order of Court, to so do.

 

 

RECRUITER:

We obtain personally identifiable information/data which may include, but not limited to, name of recruiting firm, contact address, email address, personal details of representatives of recruiting firm, number of years standing in industry and incorporation/registration details.

We may disclose your personally identifiable information/data to Candidates, such as when a Candidate needs extra information about whom to contact when going for an interview or an assignment with/for the recruiter.

 

  1. SECURITY

We undertake to do our utmost in protecting your privacy through the engagement and use of security technology. We have taken strong measures to protect the security of your personal information and to ensure that your choices for its intended purpose are honoured. However, because, absolute security of information exchanged and transmitted on the internet is imaginary and infeasible, we cannot guarantee the security of exchanged and transmitted data by you through the Site; all exchange and transmission is at your risk.

  1. COMMUNICATION

We may contact you through email or phone texts to send you updates about suitable employment opportunities or offers for you, employment/career-related tips, interview tips and questionnaires to conduct certain employment/work surveys.

To effectively carry out the above duties, we may occasionally hire other companies to provide limited services on our behalf, including packaging and sending mails or texts to you. We will only provide those companies with the information they need to deliver the service and they are prohibited from using that information for any other purpose.

For all your email correspondences with us, we hold all correspondences within our safe and secure email filing system.

 

  1. DATA RETENTION

We will retain and process User’s personal data during the subsistence of user’s registration/account, the subsistence is determined for each category of User below:

  • Candidates: period before and until account is terminated, suspended or deleted.
  • Recruiters- period/duration covered by payment of subscription plan/fee, paid by them.

 In the event of account suspension, deletion or termination, by User or by the exercise of our discretionary powers or by expiration of subscription for recruiters, we shall have the right to continue to store only the personal data needed for a certain period after the suspension, deletion or termination of account, so as to meet any legal obligations or for ease in the event that you come back after a while for new opportunities, for the duration set out below. After which, such personal data shall be deleted.

  • Candidates: 18 months, post suspension, deletion or termination of account.
  • Recruiters: 36 months, post expiration of subscribed plan.

Also, we do not guarantee the complete removal of your content or information, as, some of your information or content may have been reposted, stored, modified or reproduced by another user.

 

  1. USER RIGHTS AS DATA SUBJECT

As a data subject, you have some rights and they are as follows:

  1. Right of Access: You have the right to request and have access to a copy of the data or information we have of you, as provided for under Section 86 of the Act. Take note that this right is not absolute and is subject to the privacy rights and entitlements of others.
  2. Right to Rectification: In accordance with Sections 87 and 89 of the Act, you may exercise your right to rectify your data with us, when you believe that the data or information we have and hold of you is incomplete or inaccurate.
  3. Right to be informed: You have a right to be informed of our data processing activities and process. This is contained in and provided for by this privacy policy and any related communications we may send you.
  4. Right to Portability: You may request that we transfer the data we have and hold of you to another organisation, where we hold same in electronic form. This right is subject to certain restrictions and applies to:
  • Personal data provided by you;
  • Personal data that we processed based on your consent in order to fulfil an obligation;
  • Automatically processed data.
  1. Right to Erasure: You may request that we erase your personal data, where there is no overriding legitimate or legal basis in relation to the processing of personal data. Consequently, we will take all reasonable steps to ensure erasure.
